Unit 245 – Understand the context of supporting individuals with learning disabilities.

1.1 a) Human Rights act 1998
b) Equality act 2010
c) Disability discrimination act 1995
d) Mental Capacity act 2005

1.2 a) Improved the standards of care given to individuals with a learning disability, it gave individuals the right to life, right to privacy and the right not to be subjected to degrading or inhuman treatment.

b) Protects the rights of individuals and promotes equality for all, gives the right for all people to be treated the same regardless of race, age, sex or disability.

c) Made it unlawful for employers to discriminate against people based on a disability, it gave individuals a greater chance

Legal Advocacy - When a lawyer or trained legal person speaks up for you. Carried out by trained lawyers and barristers, this is for legal cases or for court.
Legal advocates assist people to exercise or defend their rights

Professional Advocacy - Representation by members of services involved in a person’s life, for example social workers or health workers. Whilst this is an important form of advocacy, most independent advocacy agencies would stress the limitations of this type of advocacy and recognize the potential conflict of interest that may arise out of professionals advocating on their service users behalf.

Statutory Advocacy - Where there is a statutory duty to provide advocacy following government legislation such as Independent Mental Health Advocacy (IMHA) and Independent Mental Capacity Advocacy (IMCA).

Family and Friend Advocacy - Where a person’s family member, or members, or friend(s) play a part in advocating on their behalf. Most of us will have used, or provided this support at some time in our lives whether we realised it or not.

4.4 Seeing a person as an individual is an important aspect of affording them respect and dignity. Making choices for most of us is part of our everyday life. It is a fundamental part of us being recognised and respected as an individual. Such choices contribute to us having control over our lives and individuals with learning disabilities also have
